ELIGIBILITY
Open to legal U.S. residents who are 18 years of age and older and who are employed as middle school or high school teachers for Grades 5 through 12 in accredited public schools in the United States that are organized and primarily operated for educational purposes, and being considered tax-exempt under section 501(c)(3) of the Internal Revenue Service Tax Code or being registered as a public school with the National Center for Educational Statistics. Employees of Fourier Systems, LLC (the “Sponsor”), its subsidiaries, affiliates, contest administrator, advertising and promotion agencies and members of the immediate families (spouses and parents, children and siblings and their spouses) and persons living in the same household of such individuals are not eligible. Any determinations of eligibility will be made by the Sponsor whose decision is final. Entrants may be subject to rules imposed by their employers relative to their participation in trade promotions and should check with their employer for any relevant policies. Void where prohibited.
JUDGING
Judging will be conducted by a panel of judges from Fourier Systems, based on the following criteria:
Content (50% of total score)
Originality/creativity of ideas (40% of total score)
Adherence to contest parameters (10% of total score)
The contest entries receiving the highest scores will be declared the winners. The winning entrants and their schools will be notified on or about March 15th 2009 and will be required to complete prize acceptance paperwork. If notification documents are returned as non-deliverable, if a winning entrant is found to be ineligible or not in compliance with these Official Rules, does not respond within the time period specified or cannot accept the terms and conditions of being a winner, the next highest scored entrant will be notified and the same process will be followed.
SUBMISSION AGREEMENT
By submitting an entry, applicants warrant and represent that their entry is their own original work created by them, has not been previously published, has not won a previous prize or award, that they own or otherwise control all of the rights to their entry materials and that their entry does not violate any law, regulation or any right of any third-party, including but not limited to rights of copyright, publicity and privacy. Submitting an entry that is copyrighted by another individual will make them responsible for any legal action the legal copyright holder might take against them. Entries may not defame or invade the rights of publicity or privacy of any person, living or deceased, or otherwise infringe upon a person's personal or proprietary rights. Sponsor reserves the right in its sole discretion to disqualify any entry at any time which, in the Sponsor’s reasonable opinion, endangers the safety or well being of any person or in the event it is determined that the entrant has not complied with these Official Rules. Submissions that are deemed by the judges in their sole discretion to be offensive or inappropriate or not in keeping with Sponsor's image will be void. Sponsor is under no obligation to correspond about entries nor will entries be acknowledged or returned.
SPONSOR AGREEMENT
Taxes on prizes and all expenses related to acceptance and use of prizes and not specified are the sole responsibility of the winning schools. Entries are accepted and prizes awarded on the condition that all entry materials are the sole property of the entrant and that they have not been accepted for publication elsewhere. By participating, entrants agree [a] to these rules and decisions of Sponsor and judges, which shall be final in all respects relating to this contest; and [b] to release, discharge and hold harmless Sponsor, their affiliates, subsidiaries, advertising and promotion agencies, agents and representatives and their respective officers, directors and employees from any and all injuries, liability, losses and damages of any kind resulting from their participating in the contest or their acceptance, use or misuse of a prize including, without limitation, personal injury, death and property damage, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy. Winners agree to grant Sponsors: [a] all rights of ownership, reproduction and use of entry for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-fee, worldwide right, in all media (now known or later developed) to use, publish, alter or otherwise exploit entries; and [b] use of his/her name and/or photograph for advertising, publicity and promotional purposes in all media, including but not limited to on air and within Sponsor’s website without compensation (unless prohibited by law) and agree to execute specific consent to such use if asked to do so. Sponsors, their affiliates, subsidiaries, advertising and promotion agencies, agents and representatives and their respective officers, directors and employees are not responsible for and shall not be liable for [a] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; [b] failed, incomplete, garbled or delayed computer transmissions; [c] lost, late, misdirected, damaged, incomplete entries or postage-due mail; or [d] any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the contest and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsors at their sole discretion. Entry information becomes property of Sponsor. No prize transfer, cash redemption or substitution. All federal, state and local regulations apply.
